Kerala's guidelines state that a resident "reserves the right to terminate a contract for stay and to discontinue staying there at any point of time he desires," and on doing so "is entitled to get the money or property deposited at the Care Home as advance maintenance fee back after deducting dues if any pending to be remitted at the care home." The operator is separately required to return any money or valuables held for safekeeping.
That's a clear right to a refund of the advance minus legitimate dues. What isn't specified anywhere in the guidelines is a maximum number of days the operator has to actually process and pay that refund. What to check before paying a deposit
Get the exact deposit amount, and what it's specifically for (advance maintenance fee vs. a separate refundable security deposit vs. a non-refundable admission or processing fee — these can be different line items with different refund rules) written down before you pay. Ask what "dues" could legitimately be deducted, and whether that list is capped or open-ended. And ask directly what the actual refund timeline is in practice — not what the guidelines require, since they don't set one — and get that answer in writing.

- The exact amount, and which specific fee it corresponds to (advance maintenance, security deposit, or non-refundable admission fee)
- What categories of "dues" can be deducted from the refund, and whether that list is closed or open-ended

Research gaps
A commonly repeated claim is that refunds must be processed within three months. This research did not find that figure in Kerala's own care-home guidelines. It may originate from a different scheme (for example, interest-free maintenance security deposit rules under some real-estate/RERA contexts, which are a distinct legal mechanism from a Pay Home's advance maintenance fee) — treat any specific refund deadline as a contractual commitment you need from the operator directly, not a state-guaranteed right, unless you can point to the specific source.
